Terms of service

The terms under which we license and host the Jerskit jersey design script.

These terms govern your use of [DOMAIN] and of the Jerskit software, whether we host it for
you or license it to you as source. By ordering a plan you accept them.

Who you are contracting with

What we provide

  • Hosted plans (Starter, Pro). We run the software on our infrastructure, keep it updated

and available, and give you an admin account. The plan you choose decides which templates
and features are unlocked.

  • Source licence. We deliver the complete source files and the database schema, and you

run them on infrastructure you control. The licence is perpetual, non-exclusive and
non-transferable, for [NUMBER] installation(s) operated by you or your client.

What you may and may not do

You may modify the source, rebrand it and use it to serve your own customers. You may not
resell, sublicense or redistribute the source itself as a product, publish it in a public
repository, or remove licence notices from the files.

You are responsible for the content you and your customers upload, for holding the rights to
any logo, badge or sponsor mark you reproduce, and for your own customers' data.

Fees and renewal

Prices are shown in the pricing section and exclude VAT unless stated otherwise. Hosted plans
are billed [BILLING CYCLE] in advance and renew automatically until cancelled. Source licences
are a single payment. Cancel by writing to [CONTACT EMAIL] before the next renewal date;
cancellation takes effect at the end of the paid period.

Refunds and the right of withdrawal

Consumers in the EU have a 14-day right of withdrawal. For digital content delivered
immediately that right lapses once delivery begins with your express consent, which is why we
ask for it before sending source files. For hosted plans we offer a [REFUND WINDOW, e.g.
14-day] money-back period. Business customers: [STATE YOUR POLICY].

Availability

We aim for [UPTIME TARGET, e.g. 99.5%] monthly availability on hosted plans, excluding
announced maintenance and failures at upstream providers. That is a target, not a warranty,
unless a separate service level agreement says otherwise.

Support and updates

Hosted plans include support with the response time stated in your plan, and updates at no
extra cost. Source licences include [SUPPORT SCOPE] and [UPDATE PERIOD] of updates from the
delivery date.

Liability

We are liable without limit for intent and gross negligence, and for injury to life, body or
health. Otherwise our liability is limited to foreseeable damage typical for this kind of
contract, and in total to the fees you paid in the [LIABILITY PERIOD, e.g. 12 months] before
the event. We are not liable for lost profits or for data you did not back up. Nothing here
excludes liability that cannot be excluded by law.

Termination

Either side may terminate for a material breach that is not fixed within 14 days of written
notice. When a hosted plan ends we keep your data available for export for [EXPORT WINDOW,
e.g. 30 days] and delete it afterwards.

Governing law

These terms are governed by the law of [JURISDICTION], and the courts of [VENUE] have
jurisdiction, without depriving consumers of the protection of mandatory rules in their
country of residence.

Changes

We may change these terms with [NOTICE PERIOD, e.g. 30 days] notice by e-mail. If you object,
you may terminate before the change takes effect.
